(وَيَتَّجِهُ أَنَّ فَائِدَتَهُ) رَدُّ الْمَبِيعِ عَلَى الْقِنِّ وَأَخْذُ الثَّمَنِ مِنْهُ (أَوْ إمْسَاكُهُ) ؛ أَيْ؛ الْمَبِيعِ بِالثَّمَنِ الَّذِي بِيعَ بِهِ، و (لَا) يَجُوزُ لِلْمُشْتَرِي (أَخْذُ أَرْشٍ) مَعَ الْإِمْسَاكِ؛ لِأَنَّ الْقِنَّ لَمَّا صَدَّقَهُ سَيِّدُهُ عَلَى عَدَمِ الْإِذْنِ؛ صَارَ مَمْنُوعًا مِنْ التَّصَرُّفِ. وَهُوَ مُتَّجِهٌ
