وَشُرِطَ تَعْيِينُ وَكِيلٍ وَمُوَكَّلٍ فِيهِ، فَلَا يَصِحُّ وَكَّلْتُ أَحَدَ هَذَينِ، أَوْ فِي شِرَاءِ أَحَدِ هَذَينِ،

(وَشُرِطَ) لِصِحَّةِ وَكَالَةٍ (تَعْيِينُ وَكِيلٍ وَمُوَكَّلٍ فِيهِ) ؛ كَأَنْ يَقُولَ: وَكَّلْت فُلَانًا فِي كَذَا، (فَلَا يَصِحُّ) أَنْ يَقُولَ (وَكَّلْت أَحَدَ هَذَيْنِ) ؛ لِلْجَهَالَةِ، (أَوْ) وَكَّلْتُك (فِي شِرَاءِ أَحَدِ هَذَيْنِ) ؛ لِلْجَهَالَةِ أَيْضًا.
