(بِخِلَافِ نَحْوِ طَلَاقٍ) ؛ لِأَنَّهُ يَجُوزُ التَّوْكِيلُ فِي الْإِنْشَاءِ، فَجَازَ فِي الْإِزَالَةِ بِطَرِيقِ الْأَوْلَى (وَرَجْعَةٍ وَصَدَقَةٍ بِنَحْوِ رَغِيفٍ) وَفَلْسٍ وَتَمْرَةٍ، فَلَا يَفْتَقِرُ إلَى إذْنِ السَّيِّدِ.
