مطالب أولي النهىal-Ruhaybani

(وَيَصِحُّ) مِنْ الْوَكِيلِ (اسْتِيفَاءُ) مَا وُكِّلَ فِيهِ (بِحَضْرَةِ مُوَكِّلٍ وَغِيبَتِهِ) ؛ لِعُمُومِ الْأَدِلَّةِ، وَلِأَنَّ مَا جَازَ اسْتِيفَاؤُهُ فِي حَضْرَةِ الْمُوَكِّلِ؛ جَازَ فِي غِيبَتِهِ؛ كَسَائِرِ الْحُقُوقِ (حَتَّى فِي اسْتِيفَاءِ حَدِّ قَذْفٍ وَقَوَدٍ) .
