(وَأَنَّ الصِّحَّةَ) - أَيْ؛ صِحَّةَ الْبَيْعِ أَوْ الشِّرَاءِ بِذَلِكَ - (حَيْثُ لَا نَهْيَ) مِنْ الْمُوَكِّلِ فَإِنْ كَانَ ثَمَّ نَهْيٌ مِنْهُ؛ لَمْ يَصِحَّ. وَهُوَ مُتَّجِهٌ
