(وَكَذَا الشِّرَاءُ) فَالْوَكِيلُ فِيهِ يَمْلِكُ تَسْلِيمَ الثَّمَنِ. (وَلَا يَتَسَلَّمُ الْوَكِيلُ الْمَبِيعَ حَيْثُ لَا قَرِينَةَ) ؛ بِأَنْ اشْتَرَاهُ مِنْ شَخْصٍ غَيْرِ مَعْرُوفٍ (بِلَا إذْنِ) مُوَكِّلِهِ.
