مطالب أولي النهىal-Ruhaybani

(وَإِنْ أَخَذَ وَكِيلٌ فِي قَبْضِ دِينَارٍ هُنَا أَسَاءَ) بِأَخْذِهِ؛ لِأَنَّهُ غَيْرُ مَأْذُونٍ فِيهِ، (وَلَمْ يَضْمَنْهُ) . - أَيْ الرَّهْنَ - لِأَنَّهُ رَهْنٌ فَاسِدٌ، وَفَاسِدُ الْعُقُودِ كَصَحِيحِهَا فِي الضَّمَانِ وَعَدَمِهِ، فَمَا كَانَ الْقَبْضُ فِي صَحِيحِهِ كَانَ غَيْرَ مَضْمُونٍ فِي فَاسِدِهِ.
