مطالب أولي النهىal-Ruhaybani

(وَ) تَصِحُّ إجَارَةٌ أَرْضٍ (بِطَعَامٍ مَعْلُومٍ مِنْ جِنْسِ الْخَارِجِ) مِنْهَا (أَوْ غَيْرِهِ) - أَيْ: غَيْرِ جِنْسِهِ - كَمَا لَوْ أَجَّرَهَا سَنَةً لِزَرْعِ بُرٍّ بِقَفِيزِ بُرٍّ، وَلَمْ يَقُلْ مِمَّا يَخْرُجُ مِنْهَا، أَوْ بِقَفِيزِ شَعِيرٍ وَنَحْوِهَا؛ كَمَا لَوْ أَجَّرَهَا بِدَرَاهِمَ مَعْلُومَةٍ.
