(وَلَوْ عَمِلَا) - أَيْ: الشَّرِيكَانِ - (فِي شَجَرٍ بَيْنَهُمَا نِصْفَيْنِ، وَشَرَطَا التَّفَاضُلَ فِي ثَمَرِهِ) بِأَنْ قَالَا: إنَّ لَكَ الثُّلُثَ، وَلِي الثُّلُثَانِ؛ (صَحَّ) ؛ لِأَنَّ مِنْ شُرِطَ لَهُ الثُّلُثَانِ قَدْ يَكُونُ أَقْوَى عَلَى الْعَمَلِ مِمَّنْ شُرِطَ لَهُ الثُّلُثُ وَأُعْرَفَ بِهِ مِنْهُ،
