وَلِحَفْرِ قَبْرٍ لَزِمَهُ رَدُّ تُرَابِهِ عَلَى مَيِّتٍ؛ لأَنَّهُ الْعُرْفُ، لَا تَطْيينُهُ

(وَ) إنْ اُسْتُؤْجِرَ (لِحَفْرِ قَبْرٍ لَزِمَهُ رَدُّ تُرَابِهِ) - أَيْ الْقَبْرِ - (عَلَى مَيِّتٍ؛ لِأَنَّهُ الْعُرْفُ، وَلَا) يَلْزَمُهُ (تَطْيِينُهُ) ؛ لِأَنَّهُ لَيْسَ بِمَشْرُوعٍ، ظَاهِرُهُ وَلَوْ كَانَ الْعُرْفَ.
