وأَنَّهُ لَا يُنَافِيهِ مَا مَرَّ مِنْ عَدَمِ تَعْيِينِ نَوْع وَذُكُورَةٍ؛ لأَنَّ ذَلكَ إجَارَةُ مَنْفَعَةٍ.

(أَنَّهُ) .

أَيْ اشْتِرَاطُ ذَلِكَ - (لَا يُنَافِيه مَا مَرَّ) أَوَّلَ الْبَابِ (مِنْ عَدَمِ) اشْتِرَاطِ (تَعْيِينِ نَوْعٍ) مَأْجُورٍ (وَذُكُورَتِهِ؛ لِأَنَّ ذَاكَ إجَارَةُ مَنْفَعَةٍ) ، وَهَذَا إجَارَةُ عَيْنٍ مُرَادٍ بِهَا الِانْتِفَاعُ، وَهُوَ مُتَّجِهٌ.
