مطالب أولي النهىal-Ruhaybani

(وَيَقْبَلُ دَعْوَاهُ) - أَيْ: الْأَجِيرِ - لِحَمْلِ شَيْءٍ (تَلِفَ) ذَلِكَ (الْمَحْمُولُ) عَلَى وَجْهٍ لَا يَضْمَنُهُ بِيَمِينِهِ، (وَلَهُ) - أَيْ: الْحَامِلُ - (أُجْرَةُ حَمْلِهِ) إلَى مَحَلِّ تَلَفِهِ. ذَكَرَهُ فِي " التَّبْصِرَةِ " وَاقْتَصَرَ عَلَيْهِ فِي " الْفُرُوعِ "؛ لِأَنَّ مَا عَمَلَ فِيهِ مِنْ عَمَلٍ بِإِذْنٍ، وَعَدَمُ تَمَامِ الْعَمَلِ لَيْسَ مِنْ جِهَتِهِ.
