(وَلِوَكِيلِ بَيْتِ مَالٍ أَخْذُ) شِقْصٍ مُشْتَرَكٍ مَاتَ أَحَدُ الشَّرِيكَيْنِ، ثُمَّ بَاعَ الشَّرِيكُ نَصِيبَهُ (بِهَا) - أَيْ: بِالشُّفْعَةِ (حَيْثُ لَا وَارِثَ) لِلْمَيِّتِ،

وَإِذَا أَخَذَهُ يَضُمُّهُ إلَى مَا بِيَدِهِ مِنْ أَمْوَالِ الْمُسْلِمِينَ لِتُصْرَفَ فِيمَا أُعِدَّتْ لَهُ.
