مطالب أولي النهىal-Ruhaybani

(وَإِنْ حَفَرَ) الْمُشْتَرِي فِي الْبُقْعَةِ الْمَشْفُوعَةِ (بِئْرًا) لِنَفْسِهِ بِإِذْنِ الشَّفِيعِ لِإِظْهَارِ زِيَادَةِ ثَمَنٍ، ثُمَّ عَلِمَ، فَأَخَذَ بِالشُّفْعَةِ (أَخَذَهَا) ؛ أَيْ: أَخَذَ (شَفِيعٌ) الْبِئْرَ مَعَ الشِّقْصِ، (وَلَزِمَهُ) - أَيْ: الشَّفِيعَ - لِلْمُشْتَرِي (أُجْرَةُ مِثْلِ حَفْرِهَا) ؛ لِأَنَّ الْمُشْتَرِيَ لَمْ يَتَعَدَّ بِحَفْرِهَا.
