وَلَا يَضْمَنُ مُسَافِرٌ أُودِعَ فَسَافَرَ بِها فَتَلِفَتْ بالسَّفَرِ

(وَلَا يَضْمَنُ مُسَافِرٌ أُودِعَ) - بِالْبِنَاءِ لِلْمَجْهُولِ - وَدِيعَةً فِي سَفَرِهِ، (فَسَافَرَ بِهَا) الْوَدِيعُ؛ أَيْ: أَتَمَّ سَفَرَهُ، (فَتَلِفَتْ فِي السَّفَرِ) ؛ لِأَنَّ إيدَاعَ الْمَالِكِ فِي هَذِهِ الْحَالَةِ يَقْتَضِي الْإِذْنَ فِي السَّفَرِ بِهَا.
