مطالب أولي النهىal-Ruhaybani

(لَا إنْ قَالَ) الْمُنَادِي غَيْرَ رَبِّ الضَّالَّةِ فِي النِّدَاءِ: (قَالَ فُلَانٌ مَنْ رَدَّهَا) - أَيْ: ضَالَّتِي - فَلَهُ دِينَارٌ، وَلَمْ يَكُنْ رَبُّهَا قَالَ ذَلِكَ فَرَدَّهَا إنْسَانٌ لَمْ يَضْمَنْ الْمُنَادِي؛ لِأَنَّهُ لَمْ يَلْتَزِمْ الْعِوَضَ، وَالرَّادُّ مُقَصِّرٌ بِعَدَمِ الِاحْتِيَاطِ.
