مطالب أولي النهىal-Ruhaybani

(فَإِنْ تَطَهَّرَ بِهِ) - أَيْ: الْمَاءِ الْمَذْكُورِ - (غَيْرُ الْأَوْلَى) بِهِ كَمُحْدِثٍ مَعَ ذِي نَجَسٍ: (أَسَاءَ) ، لِفِعْلِهِ مَا لَيْسَ لَهُ، (وَصَحَّتْ) طَهَارَتُهُ، لِأَنَّ الْأَوْلَى لَمْ يَمْلِكْهُ لِكَوْنِهِ أَوْلَى وَإِنَّمَا رَجَحَ لِشِدَّةِ حَاجَتِهِ.
