وَلَوْ كَانَ الْإِمَامُ أَوْ نَائِبُهُ، وَآخِذُهُ عَلَى سَبِيلِ الِالْتِقَاطِ، لَا عَلَى سَبِيلِ الْحِفْظِ؛ لِأَنَّ الْتِقَاطَ ذَلِكَ غَيْرُ مَأْذُونٍ فِيهِ مِنْ الشَّارِعِ،
