مطالب أولي النهىal-Ruhaybani

(لَا إنْ تَبِعَ) شَيْءٌ مِنْ الضَّوَالِّ الْمَذْكُورَةِ (دَوَابَّهُ فَطَرَدَهُ) ؛ فَلَا ضَمَانَ عَلَيْهِ، (أَوْ دَخَلَ) شَيْءٌ مِنْهَا (دَارِهِ فَأَخْرَجَهُ) ؛ فَلَا ضَمَانَ عَلَيْهِ، حَيْثُ لَمْ يَأْخُذْهُ، وَلَمْ تَثْبُتْ يَدُهُ عَلَيْهِ، (وَلَا) إذَا كَانَ الْمَأْخُوذُ (كَلْبًا الْتَقَطَهُ) ؛ فَإِنَّهُ لَا ضَمَانَ فِيهِ؛ لِأَنَّهُ لَيْسَ بِمَالٍ.
