(وَلَوْ عَلِمَ الثَّانِي بِالْأَوَّلِ، فَرَدَّهَا لَهُ) - أَيْ: لِلْأَوَّلِ - (فَإِنْ أَبَى) الْأَوَّلُ (أَخْذَهَا) فَهِيَ (لِلثَّانِي) ؛ لِأَنَّ الْأَوَّلَ تَرَكَ حَقَّهُ فَسَقَطَ.
