وَلَوْ قَال رَبُّهَا بَعْدَ تَلَفِهَا بِحَوْلِ تَعْرِيفٍ أَخَذْتَهَا لِتَذْهَبَ بِهَا وَقَال مُلْتَقِطٌ لأُعَرِّفَهَا فَقَوْلُهُ بِيَمِينِهِ

مطالب أولي النهىal-Ruhaybani

(وَلَوْ قَالَ رَبُّهَا) - أَيْ: اللُّقَطَةِ - (بَعْدَ تَلَفِهَا) بِيَدِ الْمُلْتَقِطِ، (بِحَوْلِ تَعْرِيفٍ) ، بِلَا تَفْرِيطِ الْمَشْرُوعِ: عَلَيْك ضَمَانُهَا؛ لِكَوْنِكَ (أَخَذْتَهَا لِتَذْهَبَ بِهَا) لَا لِتُعَرِّفَهَا، (وَقَالَ مُلْتَقِطٌ) : بَلْ أَخَذْتُهَا (لِأُعَرِّفَهَا) ؛ فَالْقَوْلُ (قَوْلُهُ) - أَيْ: الْمُلْتَقِطِ - (بِيَمِينِهِ) .

ذَكَرَهُ الْمَجْدُ فِي شَرْحِهِ " لِأَنَّهُ مُنْكِرٌ، وَالْأَصْلُ بَرَاءَتُهُ.
