(فَإِنْ تَلِفَتْ) اللُّقَطَةُ (بِيَدِ أَحَدِهِمْ) بِغَيْرِ تَفْرِيطٍ؛ فَلَا ضَمَانَ عَلَيْهِ (وَ) إنْ (فَرَّطَ) فِي حِفْظِهَا؛ (ضَمِنَ) مَا تَلِفَ مِنْهَا بِتَفْرِيطِهِ فِي مَالِهِ.
