مطالب أولي النهىal-Ruhaybani

(فَإِنْ شَهِدَتْ) لِمُدَّعِي رِقِّ اللَّقِيطِ أَوْ مَجْهُولِ النَّسَبِ (بَيِّنَةٌ) بِدَعْوَاهُ؛ (حُكِمَ لَهُ بِهَا) - أَيْ: بِبَيِّنَتِهِ - (وَنُقِضَ تَصَرُّفُهُ) الْوَاقِعُ مِنْهُ قَبْلَ أَنْ يُحْكَمَ بِهِ لِمُدِعِّ رِقِّهِ؛ لِأَنَّهُ بَانَ قَدْ تَصَرَّفَ بِدُونِ إذْنِ سَيِّدِهِ.
