(وَيُقْطَعُ سَارِقُهُ) - أَيْ: الْمَوْقُوفِ - (وَسَارِقُ نَمَائِهِ إذَا كَانَ عَلَى مُعَيَّنٍ) ؛ وَلَا شُبْهَةَ لِلسَّارِقِ؛ لِتَمَامِ الْمِلْكِ فِيهِ.

قَالَ فِي " الشَّرْحِ ": فَيَسْتَوْفِيهِ بِنَفْسِهِ وَبِالْإِجَارَةِ وَالْإِعَارَةِ وَنَحْوِهَا إلَّا إنْ عَيَّنَ فِي الْوَقْفِ غَيْرَ ذَلِكَ.
