وَوعَاءُ هَدِيَّةٍ كَهِيَ مَعَ عُرفٍ كَقَوصَرَّةِ تَمْرٍ،

(وَوِعَاءُ هَدِيَّةٍ كَهِيَ) فَلَا يُرَدُّ (مَعَ عُرْفٍ) بِذَلِكَ فَإِنْ لَمْ يَكُنْ عِرْفٌ رَدَّهُ، قَالَهُ فِي " الْفُرُوعِ ". قَالَ الْحَارِثِيُّ: لَا يَدْخُلُ الْوِعَاءُ إلَّا مَا جَرَتْ بِهِ عَادَةٌ (كَقَوْصَرَّةِ تَمْرٍ) وَنَحْوِهَا انْتَهَى.
