(وَإِنْ اخْتَلَفَا فِي شَرْطِ عِوَضٍ) بِأَنْ قَالَ الْوَاهِبُ: شَرْطُنَا الْعِوَضُ، وَأَنْكَرَهُ مَوْهُوبٌ لَهُ (فَقَوْلُ) مَوْهُوبٍ لَهُ (مُنْكَرٌ) بِيَمِينِهِ، لِأَنَّ الْأَصْلَ عَدَمُهُ وَبَرَاءَةُ ذِمَّتِهِ.
