(وَلَا) تَصِحُّ (هِبَةُ مَجْهُولٍ لَهُمَا) أَيْ: الْوَاهِبِ وَالْمُتَّهِبِ (لَمْ يَتَعَذَّرْ عِلْمُهُ) نَصًّا كَنَحْلٍ فِي كُوَّارَةٍ، وَحَمْلٍ فِي بَطْنٍ وَنَحْوِهِ، وَتَقَدَّمَ آنِفًا؛ لِأَنَّ الْهِبَةَ تَمْلِيكٌ؛ فَلَا تَصِحُّ فِي الْمَجْهُولِ كَالْبَيْعِ
