مطالب أولي النهىal-Ruhaybani

(وَإِنْ كَانَتْ الْمُحَابَاةُ مَعَ وَارِثٍ صَحَّ الْبَيْعُ فِي ثُلُثِهِ) - أَيْ: الْعَبْدِ بِالْعَشَرَةِ - (وَلَا مُحَابَاةَ) حَيْثُ لَمْ تُجِزْ الْوَرَثَةُ، وَلِلْأَجْنَبِيِّ وَالْوَارِثِ فَسْخُ الْبَيْعِ؛ لِتَفْرِيقِ الصَّفْقَةِ.
