وَلَوْ وَصَّى أَحَدُهُمَا لِلآخَرِ فَلَهُ كُلُّهُ إرْثًا وَوَصيَّةً

(وَلَوْ وَصَّى أَحَدُهُمَا) - أَيْ: أَحَدُ الزَّوْجَيْنِ - (لِلْآخَرِ) بِكُلِّ مَالِهِ، وَلَا وَارِثَ لَهُ غَيْرَهُ (فَلَهُ) - أَيْ: الْمُوصَى لَهُ - (كُلُّهُ) - أَيْ: كُلُّ الْمَالِ - فَيَأْخُذُهُ جَمِيعَهُ (إرْثًا وَوَصِيَّةً) عَلَى الصَّحِيحِ مِنْ الْمَذْهَبِ؛ لِأَنَّهُ لَا يُرَدُّ عَلَيْهِمَا.
