وَإِنْ شَرَطَ عَدَمَ تَزْويجِهَا فَفَعَلَتْ وَأَخَذَتْ الْوصِيَّةَ، ثُمَّ تَزَوَّجَتْ رَدَّتْ مَا أَخَذَتْ،

مطالب أولي النهىal-Ruhaybani

(وَإِنْ) (شَرَطَ) فِي وَصِيَّتِهِ (عَدَمَ تَزْوِيجِهَا) أَيْ: أُمِّ وَلَدِهِ أَوْ زَوْجَتِهِ الْحُرَّةِ (فَفَعَلَتْ) أَيْ: وَافَقَتْ عَلَيْهِ (وَأَخَذَتْ الْوَصِيَّةَ، ثُمَّ تَزَوَّجَتْ) (رَدَّتْ مَا أَخَذَتْ) مِنْ الْوَصِيَّةِ؛ لِبُطْلَانِ الْوَصِيَّةِ بِفَوَاتِ شَرْطِهَا، وَفُرِّقَ بَيْنَهُ وَبَيْنَ الْعِتْقِ بِتَعَذُّرِ رَفْعِهِ.
