"ومن دخل الحرم بصيد فعليه أن يرسله فيه إذا كان في يده" خلافا للشافعي رحمه الله فإنه يقول حق الشرع لا يظهر في مملوك العبد لحاجة العبد.

ولنا أنه لما حصل في الحرم وجب ترك التعرض لحرمة الحرم إذ صار هو من صيد الحرم فاستحق الأمن لما روينا
