"ويرجع الآخذ على القاتل" وقال زفر رحمه الله لا يرجع لأن الآخذ مؤاخذ بصنعه فلا يرجع على غيره ولنا أن الآخذ إنما يصير سببا للضمان عند اتصال الهلاك به فهو بالقتل جعل فعل الآخذ علة فيكون في معنى مباشرة علة العلة فيحال بالضمان عليه.
