"وإن تزوجت أمة بغير إذن مولاها ثم أعتقت صح النكاح" لأنها من أهل العبارة وامتناع النفوذ لحق المولى وقد زال "ولا خيار لها" لأن النفوذ بعد العتق فلا تتحقق زيادة الملك كما إذا زوجت نفسها بعد العتق
