"وإن قال أردت الظهار فهو ظهار" وهذا عند أبي حنيفة وأبي يوسف رحمهما الله وقال محمد رحمه الله ليس بظهار لانعدام التشبيه بالمحرمة وهو الركن فيه ولهما أنه أطلق الحرمة وفي الظهار نوع حرمة المطلق يحتمل المقيد
