"ولو قذف مجوسيا تزوج بأمه ثم أسلم يحد عند أبي حنيفة رحمه الله وقالا لا حد عليه" وهذا بناء على أن تزوج المجوسي بالمحارم له حكم الصحة فيما بينهم عنده خلافا لهما وقد مر في النكاح
