"فإن ضرب سوطا في قذف ثم أسلم ثم ضرب ما بقي جازت شهادته" لأن رد الشهادة متمم للحد فيكون صفة له والمقام بعد الإسلام بعض الحد فلا يكون رد الشهادة صفة له وعن أبي يوسف رحمه الله أنه رد شهادته إذ الأقل تابع للأكثر والأول أصح.
