"وكل مال هو في يده" لقوله عليه الصلاة والسلام "من أسلم على مال فهو له" ولأنه سبقت يده الحقيقية إليه يد الظاهرين عليه "أو وديعة في يد مسلم أو ذمي" لأنه في يد صحيحة محترمة ويده كيده
