فَإِن أنْفق الْمُلْتَقط عَلَيْهَا بِغَيْر إِذن الْحَاكِم فَهُوَ مُتَبَرّع

"فإن أنفق الملتقط عليها بغير إذن الحاكم فهو متبرع" لقصور ولايته عن ذمة المالك وإن أنفق بأمره كان ذلك دينا على صاحبها لأن للقاضي ولاية في مال الغائب نظرا له وقد يكون النظر في الإنفاق على ما نبين.
