"ومن باع نخلا أو شجرا فيه ثمر فثمرته للبائع إلا أن يشترط المبتاع" لقوله عليه الصلاة والسلام: "من اشترى أرضا فيها نخل فالثمرة للبائع، إلا أن يشترط المبتاع" ولأن الاتصال وإن كان خلقة فهو للقطع لا للبقاء فصار كالزرع.
