قال: "فإن امتنع حبسه في كل دين لزمه بدلا عن مال حصل في يده كثمن المبيع أو التزمه بعقد كالمهر والكفالة" لأنه إذا حصل المال في يده ثبت غناه به، وإقدامه على التزامه باختياره دليل يساره إذ هو لا يلتزم إلا ما يقدر على أدائه، والمراد بالمهر معجله دون مؤجله.
