قال: "وكذلك إن رده عليه بعيب يحدث مثله ببينة أو بإباء يمين" ؛ لأن البينة حجة مطلقة، والوكيل مضطر في النكول لبعد العيب عن علمه باعتبار عدم ممارسته المبيع فلزم الآمر.
