"وإن أنكر سأل المدعي البينة" لقوله عليه الصلاة والسلام : "ألك بينة؟" فقال لا، فقال: "لك يمينه" سأل ورتب اليمين على فقد البينة فلا بد من السؤال ليمكنه الاستحلاف.
