قال: "فإن طلبها صاحبها فحبسها وهو يقدر على تسليمها ضمنها" لأنه متعد بالمنع، وهذا لأنه لما طالبه لم يكن راضيا بإمساكه بعده فيضمنه بحبسه عنه.
