قال: "ويضمن لشريكه نصف عقرها" لوطئه جارية مشتركة. قال: "ونصف قيمتها" لأنه تملك نصفها بالاستيلاد وهو تملك بالقيمة. قال: "والولد ولد الأول" لأنه صحت دعوته لقيام المصحح، وهذا قولهم جميعا. ووجهه ما بينا.
