"ولو دبر عبده جاز" لأنه يوجب حق العتق فيعتبر بحقيقته إلا أنه لا تجب السعاية ما دام المولى حيا لأنه باق على ملكه وإذا مات ولم يؤنس منه الرشد سعى في قيمته مدبرا لأنه عتق بموته وهو مدبر، فصار كما إذا أعتقه بعد التدبير
