"وكذا بالفاحش عند أبي حنيفة رحمه الله خلافا لهما" هما يقولان إن البيع بالفاحش منه بمنزلة التبرع، حتى اعتبر من المريض من ثلث ماله فلا ينتظمه الإذن كالهبة. وله أنه تجارة والعبد متصرف بأهلية نفسه فصار كالحر، وعلى هذا الخلاف الصبي المأذون.
