قال: "والمسلم والذمي في الشفعة سواء" للعمومات ولأنهما يستويان في السبب والحكمة فيستويان في الاستحقاق، ولهذا يستوي فيه الذكر والأنثى والصغير والكبير والباغي والعادل والحر والعبد إذا كان مأذونا أو مكاتبا.
