"وإن لم يرسله أحد فزجره مسلم فانزجر فأخذ الصيد فلا بأس بأكله" ؛ لأن الزجر مثل الانفلات؛ لأنه إن كان دونه من حيث إنه بناء عليه فهو فوقه من حيث إنه فعل المكلف فاستويا فصلح ناسخا
