قال: "ومن رمى صيدا فأصابه ولم يثخنه ولم يخرجه عن حيز الامتناع فرماه آخر فقتله فهو للثاني ويؤكل" ؛ لأنه هو الآخذ، وقد قال عليه الصلاة والسلام : "الصيد لمن أخذ"
