"ولو دفع العدل إلى الراهن أو المرتهن ضمن" ؛ لأنه مودع الراهن في حق العين ومودع المرتهن في حق المالية وأحدهما أجنبي عن الآخر، والمودع يضمن بالدفع إلى الأجنبي
